Appellate court says airport can switch taxi companies

A lawsuit to stop the Port of Seattle from switching taxi companies at Sea-Tac Airport has hit a major roadblock.
An appellate court ruled Monday the Seattle-Tacoma International Taxicab Association had no legal ground to stop the airport from switching to Yellow Cab. That could signal an end to STITA's 20-year tenure at the airport.
STITA sued the Port of Seattle to overturn a bid process in which it lost to Yellow Cab, Seattle's largest cab company, which was awarded 5-year contract to become the new exclusive on-demand cab service at the airport.
"STITA waived any right it had to challenge the validity of the request for proposal when it submitted the proposal," wrote Judge Marlin Applewick in a unanimous opinion for the Court of Appeals.
The court also wrote that STITA had not demonstrated a "clear legal or equitable right."
In a prepared statement, STITA representatives say the company plans to ask the state Supreme Court to review the decision. STITA has 30 days to file an appeal. The Supreme Court would then have to agree to hear the case.
Taxi service is supposed to switch Sept. 1 under the new contract. A court order in effect since February bars port officials from signing the contract while an appeal is pending.
Port officials have said they are confident the bidding process was fair, legal and transparent, and that the change would mean little difference to airport customers.
"We're pleased with the court's decision. We hope to be able to move forward as soon as we can. Whether or not STITA follows through to the next step, we'll have to wait and see," Port spokesman Perry Cooper said.
STITA was formed in 1989 to provide reliable cab service at the airport and has held the contract since. Other cab companies could drop people off, but couldn't pick anyone up on Port property.
"As we've said through this whole process, none of this was put together because we were disappointed with the work that STITA has done," he said. "They've been a great partner."
About 400 drivers could be forced to find work elsewhere. Yellow Cab says it could absorb many of the drivers as it expands to meet the Port's requirement of providing 200 cabs to serve the airport.
STITA's lawsuit alleges the Port's bidding process was flawed because its requirements run afoul of state law on airport concession fees and undermine King County's ability to set taxi rates.
The court ruled the contract did not appear to violate any of those laws.
Port officials opened the taxi contract to bidding on recommendations from an audit and scored competitors based on their financial strength, business plan and ability to reduce deadheading -- the term for cabs that must return empty to the airport because they aren't licensed for pick-ups in Seattle. Yellow Cab, the largest company, offered to pay the biggest concession fee -- 13 percent, or about $18.3 million over the life of the contract.
Also pending is a separate lawsuit from Farwest Taxi against Yellow Cab and the Port of Seattle. Farwest, which had bid on the Port contract in a joint venture with Yellow Cab, alleges that Yellow took sensitive business information from the joint bid to boost its own proposal's chances.
The lawsuit alleges it was improper to allow Chris van Dyk, a Yellow Cab representative, to draft both proposals.
At a recent Port Commission meeting, STITA representatives filed an additional protest over changes they say were rengotiated in the contract requirements after the bid was over. They say there are multiple questions about whether Yellow Cab can meet the Port's expectations on customer service, revenue and reducing environmentally-unfriendly problem of deadheading.
Cooper said port officials have the right to negotiate the contract. There were no significant changes from what was the basis of the request for proposals, he said.
